Terms of Service

Effective Date: July 1, 2025

This Terms of Service (“Agreement”) governs your use of the parking registration platform operated by Regium Management Corp (“REGIUM”, “we”, “us”, or “our”), accessible at https://park.iyap.ca (the “Site”).

By accessing, browsing, registering, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement. Your use of the Site constitutes full acceptance of these terms without the need for a separate signature or written consent.

  1. Service Description

    The Site provides a platform for users to register vehicles, manage parking sessions, and make payments where applicable. The Site is a tool intended to assist with parking compliance and does not grant or guarantee any right to park.

  2. User Responsibility (Absolute Responsibility)

    You are solely responsible for:

    • Ensuring your vehicle is properly registered
    • Entering accurate license plate and parking space details
    • Monitoring your parking session start and expiry times
    • Renewing or extending parking when required

    Any error, omission, typo, or failure to register correctly is entirely your responsibility.

    Failure to properly register your vehicle may result in ticketing or towing, and you accept full responsibility for any resulting consequences.

  3. No Guarantee of Service Availability

    The Site may be unavailable due to maintenance, outages, technical issues, or third party failures.

    You acknowledge and agree that:

    • The Site is not guaranteed to be available at all times
    • If the Site is down or inaccessible, you remain responsible for complying with parking rules
    • You must contact property management or the property owner directly if you are unable to register

    System downtime, errors, or inaccessibility do not excuse non registration and do not prevent enforcement actions.

  4. No Liability

    To the fullest extent permitted by law, REGIUM, the property owner, property manager, and any affiliated parties shall not be liable for:

    • Towing of your vehicle
    • Parking tickets or fines
    • Loss of use of your vehicle
    • Incorrect registrations or user input errors
    • System errors, bugs, outages, or delays
    • Failure of notifications, reminders, or communications
    • Actions taken by towing or enforcement companies

    The Site is provided “as-is” and “as-available” with no warranties of any kind.

  5. Limitation of Damages

    To the fullest extent permitted by law:

    • REGIUM shall not be liable for any indirect, incidental, consequential, or punitive damages
    • REGIUM’s total liability, if any, shall not exceed the amount paid by you through the Site for the specific parking session in question

  6. Parking Enforcement

    Parking is enforced by property owners and or authorized enforcement providers.

    You acknowledge that:

    • Vehicles not properly registered may be ticketed or towed without notice
    • Enforcement decisions are made independently of the Site
    • The Site does not control or override enforcement actions

  7. User Data and Prior Contact

    You agree that REGIUM may use your previously submitted information, including license plate and contact details, to attempt to contact you if your vehicle is found in violation of parking rules. This may include phone calls or SMS messages even if you are not currently registered.

  8. SMS and Communications

    By using the Site, you consent to receive SMS messages and communications related to parking, including reminders and enforcement notices.

    • Messages may be sent via third party providers such as Twilio
    • Message frequency may vary
    • You are responsible for any carrier charges or fees
    • REGIUM is not responsible for delayed or undelivered messages

  9. Payments

    Payments are processed through third party providers such as Stripe.

    You agree that:

    • All payments are final unless otherwise stated
    • You are responsible for entering correct payment details
    • REGIUM does not store full payment card information

  10. Third Party Services

    The Site relies on third party providers including but not limited to hosting services, payment processors, and messaging providers.

    REGIUM is not responsible for failures, delays, or errors caused by third party services.

  11. Prohibited Use

    You agree not to:

    • Provide false or misleading information
    • Attempt to bypass parking rules or enforcement
    • Interfere with or disrupt the Site
    • Use the Site for unlawful purposes

  12. Termination

    We reserve the right to suspend or terminate your access to the Site at any time, without notice, for any reason, including misuse or violation of this Agreement.

  13. Indemnification

    You agree to indemnify and hold harmless REGIUM, property owners, property managers, and affiliated parties from any claims, damages, losses, or expenses arising from your use of the Site or your failure to comply with parking rules.

  14. Governing Law

    This Agreement shall be governed by the laws of the Province of Ontario and the applicable laws of Canada.

  15. Changes

    We may update these Terms at any time. Continued use of the Site constitutes acceptance of the updated terms.

  17. Final Acknowledgment

    By using this Site, you acknowledge and agree that:

    • You are fully responsible for ensuring proper parking registration
    • The Site is a convenience tool and not a guarantee against enforcement
    • You accept all risks associated with incorrect, incomplete, or missing registration
    • You understand that system failures, outages, or communication issues do not relieve you of your obligations to comply with parking rules
